Frequently asked questions about residential conveyancing
What is conveyancing?
Conveyancing is the legal process of transferring legal title of a property from one person to another or the granting of a mortgage. It involves preparing or approving a Contract and Transfer Deed, reviewing the title (if acting for a buyer), carrying our pre-contract searches (if acting for a buyer), raising or replying to enquiries.
Once the buyer’s solicitor has completed their checks and once both parties have signed the Contract, Contracts can be exchanged with a 10% deposit being paid. Exchange of Contracts makes the matter legally binding on the parties. At exchange, a completion date is set. Completion is where the purchase price changes hands and the property is transferred to the buyer. The buyers solicitor will then have post completion work to carry out.
How long does conveyancing take?
Each property transaction is different and it is not always possible to say how long it will take to carry out all of the legal work necessary to complete the matter at the outset.
As a guide, assuming that the matter proceeds without undue complication, or delay, you could expect to be in a position to exchange contracts within 4 - 6 weeks after the Contract papers have been issued/received.
Completion normally takes place between 1 - 4 weeks after exchange, but the date has to be agreed by all the parties concerned.
What costs are involved in conveyancing?
We offer transparency with regard to our costs as we understand the pressure already associated with buying and selling a property. We offer a range of fixed fee services. The fee is dependent upon a number of factors which include whether the property is freehold or leasehold, a new build, whether there is a mortgage involved, the price of the property, whether there is a transfer of part of a title.
There are occasions where it is not possible to quote a fixed fee. Your matter will then be charged on a time basis in accordance with our hourly rate. You will be advised of the estimate of costs before we carry out any work.
What documents are required?
In order to carry out any legal work on your behalf we need to obtain your Identity documents and carry out an electronic anti money laundering search.
If you are purchasing a property, then we will require evidence of source of funds and source of wealth.
Any Deeds and documents (which include guarantees and warranties, planning permission, building regulation consent and indemnity policies) relating to the property in question will be required.
